Information regarding GDPR

From May 25th, 2018 on shall apply the provisions of EU Regulation 2016/679 made by European Parliament and Council of the EU called Regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (Data Protection Directive), widely known by it’s short name: General Data Protection Regulation (GDPR).

The GDPR aims primarily to strengthen the protection of citizens and residents personal data. PCG Academia sp. z o.o. undertakes to apply the provisions of GDPR as both, data controller and processor of data.

PCG Academia sp. z o.o. applies the provisions of GDPR by:

  1. Ensuring the execution of peoples rights to control over their data:

1.1.   the right to access to data - everyone has a right to make a request on paper to ask PCG Academia sp. z o.o. if their personal data are processed by company;

1.2.   the right to delete data (right to be forgotten) - the right to delete data is due if there is no legal basis for their processing; as soon as the processing purpose has come to an end, provided there is no legal basis for further processing, data are deleted by PCG Academia sp. z o.o.;

1.3.   the right to data transfer - a person whose data is processed by the company may request on paper for a data transfer; in this case, PCG Academia sp. z o.o. transfers data on a CD in the form of a protected file;

1.4.   the right to limit the processing of data - the application for limiting data processing is considered individually; if the legal requirements of Article 18 of GDPR have been met in the case, PCG Academia sp. z o.o. limits the data processing;

1.5.   the right to rectify the data - at any time people can request PCG Academia sp z o.o. to correct their personal data; the appropriate changes will be made by the company;

1.6.   the right of objection - a person whose data is processed in an automated manner (including profiling) or processed for marketing purposes may object to the processing of their data; in this case, the data will no longer be used by PCG Academia sp. o.o.

  1. Concluding act of entrustment as a processor of data;

PCG Academia sp. z o.o. is a processor of personal data used in the systems for higher education institutions. The rules for the processing of these data are regulated in the contract of entrustment concluded between PCG Academia sp. z o.o. and higher education institution. The provisions of the contract of entrustment are in accordance with Article 28 of GDPR.

  1. Ensuring the safety of the systems;

The systems offered by the company assure a high level of security, meet the requirements of GDPR and provide a guarantee of adequate protection of data processed by them. The company implements appropriate technical and organizational measures ensuring compliance with all security requirements set forth in GDPR.

  1. Regulating data transfer to Third Country;

The Third Country is a country not belonging to the European Economic Area (EEA). This means that the data transfer within the European Economic Area is treated in the same way as data transfer on the territory of Poland. This rule applies to all member states of the European Union and those member states of the European Economic Area that are not EU members (Norway, Iceland and Lichtenstein).

Personal data that are contained in the systems offered by PCG Academia sp. z o.o. are not transferred to Third Countries. The data are processed on the territory of Poland.

  1. Sharing personal data only when it’s necessary;

Personal data processed by PCG Academia sp. z o.o. may be shared with state authorities under the provisions of the law.

  1. Not processing personal data if it’s not necessary;

Personal data are processed by the company for the period, until the purpose for which they were collected is achieved, except when the law require a longer period of data processing (archiving).

  1. Informing about the rights of people whose data is being processed.

In every case of data processing PCG Academia sp. z o.o. fulfils the information obligations set forth in Articles 13 and 14 of GDPR.
